Kelly Rutherford has been going through some tough times, and it’s only getting worse. She had to get a restraining order from her ex-husband after a brutal divorce, and then she had to file for bankruptcy. And now, worst of all, she’s not getting custody of her kids. From People:
A judge has ruled that though Rutherford and her ex-husband, Daniel Giersch, technically have joint custody, their children – son Hermes, 7, and daughter, Helena, 4½ – will continue to reside in Monaco, where he lives, according to court papers obtained by PEOPLE.
The former Gossip Girl star, 45, plans to appeal the judge’s decision.
“It strikes me as outrageous and unconstitutional that children can be effectively deported in order to accommodate their exiled father without knowing why he can’t come back in and he has not been required to make any efforts to try to get back to the U.S. by the U.S. courts,” she tells PEOPLE.
Yeah, it’s kind of messed-up, to say the least. I can’t imagine how she’s feeling. She’s had more drama in her real life than she had while she was on Gossip Girl.
I hate when parents use their kids as pawns in their adult battles. Why? Why do people do that?

Gossip Girl, as we all know, was a show about the most hilariously rich jerks ever to live in Manhattan. Kelly Rutherford played a rich mom, the richest Jerry, the richest.
Anyway she had to file for bankruptcy.
The bankruptcy petition, according to legal documents obtained, shows that Rutherford, 44, spent almost $1.5 million on legal fees as the divorce/custody battle played out in court, adding that she also owes $350,000 in income taxes for 2012 and has an American Express bill of $25,251.
Rutherford and Giersch filed for divorce in 2009 after just two years of marriage. In 2012, the custody battle over the couple’s two children, Hermes, 6 and Helena, 4, intensified when it took an international turn.
Giersch, a wealthy German entrepreneur who resides in Monaco, was barred from returning to the U.S. because of a revoked visa. With a 50/50 custody split, both Rutherford and Giersch shared parenting duties but because of Giersch’s travel restrictions, the children are living with him.
Yikes. She’s not the only actress who’s getting screwed financially over a divorce.
Divorce can be crazy expensive.
Gossip Girl actress Kelly Rutherford has had a tough week after having to get a restraining order against her ex-husband, Daniel Giersch. While she definitely has a more public break up on her hands than most of us will ever have to experience, her ways of coping aren’t all that different than ours. Turns out she’s seeking comfort from her mom, who helped show her support by sending her a copy of the perennial girl-power jam “Fighter” by Christina Aguilera, which she mistakenly called “Stronger”. Rutherford attended a brunch in NYC on Saturday and spoke with People Magazine about her recovery saying, “My mom’s been through it too. I mean, not in the way that I’m going through it, but she understands. She is hysterical. She sent me that Christina Aguilera song “Stronger” and that’s when I’m laughing and crying at the same time, like, ‘Mom, I love you!’”
Rutherford is keeping a positive attitude throughout this whole ordeal and even sees it as an opportunity to help others who may be going through the exact same thing. She was quoted as saying, “I have it very lucky even though in my personal life right now I’m going through a very challenging time. I do know that there are women that I can help somehow because they’re going through a much tougher time.”
I have to say that it’s refreshing to hear a celebrity cop to the fact that their problems aren’t the biggest in the world. Rutherford is right about the fact that her money and fame will likely make this process easier on her than most new moms who go through a trying divorce, and I hope that after she’s had time to clean up her own life she’ll be spending time with various charities who help women who aren’t as lucky as she is.
Gossip Girl star Kelly Rutherford gave birth to daughter Helena this week, and I’m very disappointed that she didn’t name her baby after a handbag.
As reported a couple months ago, Rutherford is estranged from husband. Turns out, he found out about the birth of his child off the Internet.
“Media reports claiming that I neglected to attend my daughter’s birth are total lies and fabrication,” Giersch says in a statement. “I was never informed by Kelly about the birth of our daughter, nor was I invited to attend. In fact, I found out about it through Internet reports like everyone else. Although this sickens me, I am of course overjoyed that our baby was born healthy. I would’ve wanted nothing more than to hold our newborn daughter for a few moments, and I only seek to coparent both our children responsibly and with love.”
Though we obviously don’t know the whole story, it seems so cold to not let your husband know that you’ve birthed his spawn. I hope these two can find a way to come together for the sake of these children.
Well, well, this is sure to get some tongues wagging.
Kelly Rutherford — the Gossip Girl star who is currently going through the Messiest Divorce of the Century — has stated in new court papers that her two-year-old son still breast feeds, and that “we co-sleep.” She says the boy has never spent an overnight with her father. Kelly is currently petitioning the court to let her bring the boy to New York City with her so she can return to work, but her estranged husband doesn’t want this. A hearing is expected tomorrow.
I have no kids, and thus I try to avoid passing judgment on stuff like this. Lord knows my dog and I “co-sleep.” But is it a good idea for a mother to be sharing a bed with a healthy two-year-old boy? Mothers, weigh in!
I was hanging out with a girlfriend the other night, and she was all pissed off and stressed out that her boyfriend had ditched her to hang out with some friends from his flag football team — many of whom are female. He’s a good guy, too, and a good boyfriend, but she was just really annoyed and frustrated with him, and I totally understood. “You know,” I said, “shit like that makes me really happy I’m single. Sometimes I wish I had a boyfriend, but most of the time now I’m just glad I don’t have to deal with the bullshit.”
And Kelly Rutherford is a bright, shining example of THE BULLSHIT right now. The latest on the Gossip Girl star’s Divorce from Hell:
Kelly Rutheford (Lily van der Woodsen) has a big problem. We’ve learned she went to court last week and pleaded with the judge in her divorce case to let her go to NYC with her two-year-old, Hermes. The judge shut Kelly down, telling her he’ll take the issue up a week from today.
Now here’s the problemo. Sources on “Gossip Girl” tell us Kelly is supposed to be in New York to shoot by January 27. If the judge shuts her down next week that’s not going to happen. Producers could deal with a small delay and shoot her out of sequence, but if the delay is longer they could just shoot her — as in her character.
[Estranged husband David] Giersch doesn’t want Hermes to travel to NYC because he claims Kelly works insane hours and gets totally stressed out when she’s shooting.
OMG. Can you imagine dealing with this shit while you’re pregnant? Awful, awful, awful.
I also think it’s interesting that producers seem so ready to just kill off her character. It kind of makes me think she’s an enormous pain in the ass on set — which may be why her divorce is so insane, too.
Gossip Girl star Kelly Rutherford is being punished by the gods for naming her child Hermes. She’s filed paperwork to bar her estranged husband, David Giersch, from leaving the country with their two-year-old son, Hermes, for fear she’ll never see him again. He, in return, is alleging that she was violent and once threw a laptop at him. I am alleging that perhaps this kid would be best if kidnapped and raised in the People’s Republic of Congo, or anywhere else where the majority of the populace hasn’t heard of Hermes or, for that matter, herpes.
Estranged husband David Giersch countered in L.A. Superior Court with papers alleging the actress, who’s four months pregnant with their second child, has a bad temper, once throwing a laptop at him and another time trying to sock him with her fist.
Rutherford, 40, filed for divorce from Giersch, an entrepreneur, last month after being married a little over two years, seeking sole physical custody with monitored visitation. On the same day, Giersch filed for legal separation, seeking sole legal and physical custody with visitation for her.
In emergency papers filed Jan. 9, Rutherford sought to bar Giersch, 34, from traveling outside the United States with their son Hermes.
“I feel there is some risk that he will leave the country with Hermes and I will not know where they are,” Rutherford said in a declaration, adding that during their marriage, he told her of a pending investigation in his native Germany that could lead to his arrest.
Oh, and did I mention that Kelly is four months pregnant with another kid?
If you’d just named the first one “Tom” or “Mark” or “Steve,” none of this would be happening.
