Kelly Rutherford Isn’t Getting Her Kids

Kelly Rutherford has been going through some tough times, and it’s only getting worse. She had to get a restraining order from her ex-husband after a brutal divorce, and then she had to file for bankruptcy. And now, worst of all, she’s not getting custody of her kids. From People:

A judge has ruled that though Rutherford and her ex-husband, Daniel Giersch, technically have joint custody, their children – son Hermes, 7, and daughter, Helena, 4½ – will continue to reside in Monaco, where he lives, according to court papers obtained by PEOPLE.

The former Gossip Girl star, 45, plans to appeal the judge’s decision.

“It strikes me as outrageous and unconstitutional that children can be effectively deported in order to accommodate their exiled father without knowing why he can’t come back in and he has not been required to make any efforts to try to get back to the U.S. by the U.S. courts,” she tells PEOPLE.

Yeah, it’s kind of messed-up, to say the least. I can’t imagine how she’s feeling. She’s had more drama in her real life than she had while she was on Gossip Girl.

I hate when parents use their kids as pawns in their adult battles. Why? Why do people do that?

Irony: Rich Mom From Gossip Girl Files For Bankruptcy In Real Life

kelly rutherford gossip girl still screen shot season 6

Gossip Girl, as we all know, was a show about the most hilariously rich jerks ever to live in Manhattan. Kelly Rutherford played a rich mom, the richest Jerry, the richest.

Anyway she had to file for bankruptcy.

From People:

The bankruptcy petition, according to legal documents obtained, shows that Rutherford, 44, spent almost $1.5 million on legal fees as the divorce/custody battle played out in court, adding that she also owes $350,000 in income taxes for 2012 and has an American Express bill of $25,251.

Rutherford and Giersch filed for divorce in 2009 after just two years of marriage. In 2012, the custody battle over the couple’s two children, Hermes, 6 and Helena, 4, intensified when it took an international turn.

Giersch, a wealthy German entrepreneur who resides in Monaco, was barred from returning to the U.S. because of a revoked visa. With a 50/50 custody split, both Rutherford and Giersch shared parenting duties but because of Giersch’s travel restrictions, the children are living with him.

Yikes. She’s not the only actress who’s getting screwed financially over a divorce.

Divorce can be crazy expensive.

Kelly Rutherford Turns to Mom & Christina Aguilera for Support

Gossip Girl actress Kelly Rutherford has had a tough week after having to get a restraining order against her ex-husband, Daniel Giersch. While she definitely has a more public break up on her hands than most of us will ever have to experience, her ways of coping aren’t all that different than ours. Turns out she’s seeking comfort from her mom, who helped show her support by sending her a copy of the perennial girl-power jam “Fighter” by Christina Aguilera, which she mistakenly called “Stronger”.  Rutherford attended a brunch in NYC on Saturday and spoke with People Magazine about her recovery saying, “My mom’s been through it too. I mean, not in the way that I’m going through it, but she understands. She is hysterical. She sent me that Christina Aguilera song “Stronger” and that’s when I’m laughing and crying at the same time, like, ‘Mom, I love you!’”

Rutherford is keeping a positive attitude throughout this whole ordeal and even sees it as an opportunity to help others who may be going through the exact same thing. She was quoted as saying, “I have it very lucky even though in my personal life right now I’m going through a very challenging time. I do know that there are women that I can help somehow because they’re going through a much tougher time.”

I have to say that it’s refreshing to hear a celebrity cop to the fact that their problems aren’t the biggest in the world. Rutherford is right about the fact that her money and fame will likely make this process easier on her than most new moms who go through a trying divorce, and I hope that after she’s had time to clean up her own life she’ll be spending time with various charities who help women who aren’t as lucky as she is.
