Oh, that Thanksgiving Throwdown and how it’s come to haunt us all …
Or, no, but remember that time that Gabriel Aubry got his ass kicked by Halle Berry‘s new dude, Olivier Martinez? Yeah, and then everyone said that it was all Gabriel’s fault, even though it looked like he was about half a punch from having his whole entire head knocked off? We knew that everything was cool already, that no one was going to get into any trouble, but now we know that everything is cool, just as long as Gabriel Aubry doesn’t mess everything up again.
Here’s the story from TMZ:
Gabriel Aubry is in the clear in the Thanksgiving Day brawl at Halle Berry’s house … with one string attached.
TMZ has learned … the L.A. City Attorney conducted two office hearings — one where Halle and Gabriel’s sparring partner Olivier Martinez showed up together and another where Gabriel showed up alone on a different day.
Sources tell TMZ … the case has now been resolved and Gabriel will not be criminally prosecuted, PROVIDED he keeps his nose clean for a year.
TMZ previously reported … anger management was on the table as a possible condition to avoid prosecution, but the City Attorney has a policy of neither confirming nor denying specifics.
Ok, so Halle and Olivier set Gabriel up so that he couldn’t cause any trouble for the next year. That sounds great, because Gabriel really sounds like the problem here. Let’s just hope that he had to go ahead and take those anger management classes, because we all know that he’s the real monster here.

The verdict is in as far as cops are concerned … Gabriel Aubry was clearly the instigator of the Thanksgiving Day brawl at Halle Berry’s house
Law enforcement sources tell TMZ … detectives are now clear on what they believe happened — Gabriel committed two batteries on Olivier Martinez before Olivier lifted a finger to defend himself.
As TMZ first reported, as Gabriel deposited Nahla at Halle’s house Olivier walked out and said, “We have to talk.”
Based on interviewing the principles and witnesses, detectives have concluded Gabriel then pushed Olivier (battery #1) and swung at his face, making contact with his shoulder (battery #2).
Cops say at that point, Olivier responded in self defense with 3 quick punches to the face.
What’s more, law enforcement sources tell us they are “concerned” about what they believe are “Gabriel’s ongoing anger issues.”
As one law enforcement source put it, “It seems he’s still having a hard time getting over his break up with Halle.”
But here’s the good news for Gabriel — we’ve learned Halle and Olivier have both told detectives and prosecutors they do not want Gabriel charged with a crime because they do not believe it would be in Nahla’s best interests.
Law enforcement sources tell us the case will be set for an informal hearing at the city attorney’s office. The likely outcome is that Gabriel will agree to take anger management classes, although the the hearing officer could decide to just drop the entire matter after hearing both sides.
Ok, so just so we’re clear, if someone shoves you and swings and then you give them a head injury, that’s cool? As long as someone swings at you first, you can do whatever you want to them because it’s self defense? That’s neat. It’s good to know that there’s absolutely nothing weird going on here, and that Halle Berry is absolutely not blackmailing Gabriel Aubry, and that Olivier Martinez is just a good guy looking out for himself and for his new family. This is all so heartwarming, right?

Yeah, that’s all. Everything’s just cool now. A week after Olivier Martinez allegedly threatened to kill Gabriel Aubry in Halle Berry’s driveway, and a week after a series of restraining orders, and everything’s fine. No big deal. Move along here, nothing to see.
We know that everything’s fine now because yesterday at the courthouse, Halle Berry’s lawyer walked outside holding a sign that said this:
“The parties have reached an amicable agreement. There will be no further statements regarding this matter.”
Gabriel’s lawyer was on board with this statement too, so I don’t guess there’s any chance that they murdered him in the bathroom or anything.
And, of course, there are no details. I can’t see how this whole thing ended up in a way that both parties agreed on, so do you guys have any ideas? Do you think there were more threats involved? Has anyone else been having nightmares about Olivier Martinez?

Gabriel Aubry almost certainly will NOT face criminal prosecution for the violent Thanksgiving Day brawl at Halle Berry’s home … law enforcement sources tell TMZ.
As you know … Olivier Martinez made a citizen’s arrest against Gabriel and he was booked for battery. We’ve learned the case will be sent to the L.A. City Attorney’s Office Thursday, but cops will not make a recommendation as to whether Gabriel should be prosecuted.
Law enforcement sources connected to the case tell us … the consensus is that the fight was “mutual combat.” As such, we’re told it’s “highly unlikely” charges will be filed.
We’ve also heard that when Gabriel went to court yesterday in an attempt to get the judge to overturn Halle‘s restraining order, it didn’t work out to well for him. The order is up tomorrow though, so Halle will have to go to court again if she wants to keep Gabriel away.
Oh, and here’s a fun fact: Halle’s security cameras didn’t catch any footage of the fight. Apparently she had a stalker last year, and police advised her to point the cameras toward her fences, and they never got pointed back towards the front door. That may be the truth, but it’s also pretty convenient, isn’t it?
Finally, since we made a big deal out of Gabriel’s face yesterday, let’s check in on how poor Olivier is faring after the assault:

I know that I called this whole thing a mess yesterday, but now it’s really a mess. Or maybe we’re just getting more details of the massive mess that always was. Regardless, things are getting nasty.
The story we’ve been hearing is that on Thanksgiving, Gabriel Aubry took Nahla to Halle Berry‘s house, then Halle’s fiancé, Olivier Martinez, came out and said something calm and rational to Gabriel, who then punched Olivier in the face. Olivier defended himself, declared a citizen’s arrest, and then Gabriel was hauled off to jail, with a quick stop at the hospital in the middle. Based on Gabriel’s violent actions, Halle is seeking a permanent restraining order against Gabriel that would require him to stay 100 yards away from Halle, Olivier, and Nahla always. The end.
According to Gabriel’s declaration, filed by his lawyer Shawn Holley, the day before Thanksgiving, Gabriel took Nahla to her school play. Halle and Olivier showed up and Olivier walked up to Gabriel and whispered in his ear in French, “I wish I could beat the s**t out of you right now. You’re lucky we’re in a school right now. We’re going to take Nahla right now and you’re not going to follow us.”
The next day, Gabriel says he took Nahla to Halle’s at around 10 AM. He says in a completely unusual move, Olivier came out of the front door — usually the nanny was the go-between. Gabriel claims Olivier said, “We need to talk.” Gabriel says he walked toward his car to close his door when Olivier jumped off the stairs and knocked Gabriel to the ground and started brutally beating him, screaming that Gabriel cost them $3 million to fight the custody war (Halle’s failed move to take Nahla to Paris).
Gabriel says Olivier took his head in his hand and slammed it on the concrete driveway.
According to the declaration, as Olivier assaulted Gabriel he screamed that they were going to move to Paris and Gabriel had better move there too or Olivier would kill him.
Gabriel claims Olivier then said, “We called the cops,” and that when they show up, “you’re going to tell them that you’re the one who attacked me, or I’m going to kill you.”
Weird, right? Who do you believe? If you’re undecided, let me show you a picture of Gabriel taken after the fight. Keep in mind that Olivier either did this in self defense or in a fit of rage.

I’m so impressionable, you guys. Is Gabriel Aubry the villain here? Did Halle Berry orchestrate this whole thing? I don’t know. The only thing I know for sure is that Halle’s man, Olivier Martinez, is the asshole that knocks a guy unconscious and then makes a citizen’s arrest.
Oh, and I also know that things are about to get even worse in the aftermath of The Great Thanksgiving Debacle of 2012:
The L.A. County Department of Child Protective Services will be formally re-opening an abuse investigation involving Halle Berry and Gabriel Aubry’s daughter, Nahla, following the Thanksgiving brawl between her father, Gabriel Aubry, and her mother’s current boyfriend, French actor Olivier Martinez, RadarOnline.com is exclusively reporting.
“Detectives from the LAPD formally contacted CPS after Gabe’s arrest, because Nahla was present when the fight occurred,” a source close to the situation tells Radar exclusively.
“Nahla wasn’t actually involved in the melee, and by all accounts, Halle whisked her out of the driveway as soon as the fight between Olivier and Gabe started. However, DCFS was contacted because there has been a history of allegations of physical abuse. Social workers will be interviewing Halle, Gabriel and Olivier about what happened on Thanksgiving. DCFS must ensure that Nahla’s environment is safe.”
Well, at least somebody’s looking out for Nahla, I guess. Regardless of who you think is most at fault in this situation, I think it’s clear that no one’s been thinking purely about what’s best for her. So let’s just hope everything works out for that baby’s sake, and that all these dumb adults can pull it together long enough to take care of her properly.
