Can You Go to Jail for a Misdemeanor?

Mischa Barton was slapped with four misdemeanors on Tuesday, stemming from her DUI arrest late last year.

Mischa was charged with driving under the influence of alcohol or drugs, driving while having a 0.08 percent or higher blood alcohol level, driving without a valid license and possession of marijuana (28.5 grams or less).

She’s scheduled to be arraigned on Thursday.

  • first time DUI is 180 days MAX in jail — typically one never does any unless they violate probation repeatedly. Driving without a license I believe is 60 days MAX, but could be 180, again, extremely rare to do jail time for it

    Possession of less than an oz of mj (same as 28.5 g) is a straight fine — no probation, no jail, only a fine (in southern california, fine is $172). basically the same as a ticket AND it gets rubbed off your record automatically after three years.
