  • There’s no way to tell until the Dr’s diagnoses are released. If they determine her to be insane, they cannot charge her with anything related to this particular incident. However, unless the judge is a cretin or something, she will almost certainly lose all custody and visitation rights.

  • she didn’t kidnap her kids. the only thing she did was break some custody agreement rules. She’ll just lose visitation.

  • For anyone interested in the law:
    Interference with parental custody is a felony in most states today. Cali. Penal Code, § 278.5 (see below), which applies to anyone, including persons with a right to custody, prohibits the taking, enticing, keeping, withholding or concealing of a child and maliciously depriving a lawful custodian of the right to custody or maliciously depriving a person of visitation rights. However, § 278.5 does not apply to a person who has a right of custody and who deprives another of lawful custodial or visitation rights out of a good faith and reasonable belief that the child will suffer immediate bodily injury or emotional harm if left with that other person. So unless Brit can prove she had a reasonable belief the children would be in immediate danger while in Kevin’s care, she has no defense for her actions (seeing as being a complete fuck tard does not count).
    Therefore, B. Spears could be criminally charged with deprivation of custody (a felony in Cali) or violation of orders relating to child custody and visitation rights (e.g. willful disobedience of a court order constitutes a misdemeanor).

    (a) Every person who takes, entices away, keeps, withholds, or conceals a child and maliciously deprives a lawful custodian of a right to custody, or a person of a right to visitation, shall be punished by imprisonment in a county jail not exceeding one year, a fine not exceeding one thousand dollars ($1,000), or both that fine and imprisonment, or by imprisonment in the state prison for 16 months, or two or three years, a fine not exceeding ten thousand dollars ($10,000), or both that fine and imprisonment.
    (b) Nothing contained in this section limits the court’s contempt power.
    (c) A custody order obtained after the taking, enticing away, keeping, withholding, or concealing of a child does not constitute a defense to a crime charged under this section.

  • uh hum, well not law student here, but physical custody holder of to kiddies. and if my babys aren’t back at 6pm on the dot, siyanara fuckhead daddy! nah just kidding. but she did break the rules for no reason other then she wanted to keep her kiddies longer then she could, and if kfuk is the bum i think he is, he probably would want to press charges.
