From TMZ:
Tom Cruise and Katie Holmes have called a temporary truce while their lawyers try to negotiate a full divorce settlement … TMZ has learned.
Sources very familiar with the situation tell us … there are NO immediate plans for either side to go to court. There will be no court hearing Monday, Tuesday or in the foreseeable future, unless the negotiations fall apart.
Sources tell us the lawyers are negotiating child custody, visitation, child support and a property settlement.
We’re also told the whole settlement could be ratified in New York if all goes well. In other words, there may not be a move by Tom’s camp to transfer the case to California, where judges are more likely to award joint custody.
One source described the emotional state of the negotiations as “calm.”
… Really? I don’t know about all this, you guys. After a solid week of stories about how Katie Holmes spent months planning her escape from Tom Cruise and stories about how aggressive Katie is going to be during these divorce proceedings, it seems really strange to hear about how they’re suddenly making calm negotiations about the terms of the divorce.
My guess would be that TMZ is starting to take Tom’s side in this whole mess, or they’re at least making an effort to be completely neutral. Looking back, we could see the beginnings of that in the story about how the split has nothing at all to do with Scientology, and Katie is just trying to hurt Tom’s poor little feelings. At least, I hope that’s all this is. If Katie really is negotiating calmly with Tom, then that really doesn’t sound like she’s fighting as hard as we thought she was, does it?
Or it could be that Tom is afraid about all the dirt that Katie will tell everyone so instead of letting all those dark, juocy secrets come out, he decided to back down on getting sole custody of Suri and give Katie what she wants. in the end, Katie still wins. That’s my guess
I agree with Alensky. IF this report is true, it means that Team Katie’s tactics not only provided a clean, safe break from her life with Tom and his cohorts but also scared his team into backing out of a legal battle with her. I hope it’s true.

He couldn’t drive her mad with close surveillance, no private life, she’s not ashamed of what she confessed in audit.. just fed up with his callous disregard for her career, the rights of a being a woman and wife.. dictator control and mental yak-yak bullying of her and Suri.. by promoting himself first in all things..
Eh, I figure:
1) Tommy-girl didn’t want his business dragged out in court. Katie could probably kick him in the groin.
2) The scientophages DO NOT want to be out in the spotlight. They probably put pressure on TG to pay up.
3) Katie signed a fairly air-tight prenup and some of them require arbitration before going to court. It is generally cheaper and usually will mean a better settlement for Tommie.
4) Maybe Katie doesn’t want to drag this out for the kid’s sake. Maybe Tommy doesn’t WANT the kid. Katie’s not gonna want to bring that out where she can hear in court either. (I hope, anyway.)
In any event, I doubt this will go to trial as Tommy has too much to lose. He’ll have too much pressure on him to settle. Court battles can drag on for years and scientophages will be pounded on again and again. They don’t like that. Not. One. Bit.
